Warner entertainment (the people who own the rights to the birthday song) charge for it's use in public or in any media. Hasbro is merely protecting its IP so it doesn't potentially lose their rights. They've even given their blessing to MANY artists and musicians. And the fact that they are communicating with Jan shows that they actually care enough to explore options with those they have sent C&Ds to.
